ARBITRATION

A final, binding resolution — without the courtroom.

Arbitration is a private, adjudicative process in which a neutral arbitrator hears both sides and issues a decision. It is faster, less expensive, and more confidential than traditional litigation.

What is Arbitration?

In arbitration, the parties present their evidence and arguments to a neutral arbitrator — or panel — who renders a decision. Binding arbitration produces a final award enforceable in court. Non-binding arbitration provides an expert assessment that can guide settlement. ReSync offers both formats for a wide range of disputes.

How It Works

1

Agreement to Arbitrate

Parties agree to arbitrate — either through a pre-dispute clause or a post-dispute submission agreement.

2

Arbitrator Selection

The parties select a neutral arbitrator from ReSync's roster or by mutual agreement.

3

Preliminary Hearing

Ground rules, scheduling, and discovery parameters are established.

4

Hearing

Each side presents evidence, witnesses, and arguments in a structured but informal setting.

5

Award

The arbitrator issues a written decision. In binding arbitration, the award is final and enforceable.
